Pursuant to I.C. 36-9-23-31, if any fees authorized by this chapter are not paid within the time fixed for payment, they are delinquent. A penalty of 10% of the amount of the fees attaches to the delinquent fees, as specified above. The amount of the fee and penalty can be recorded as a lien onto the property. The fee and penalty plus reasonable attorney's fee may be recovered by the Town Council in a civil action in the name of the town. The town may also turn the fee over to a collection agency.
