§ 30.02 DESIGNATION AS PURCHASING AGENCY.
   (A)   (1)   The Town Council is hereby designated as the Purchasing Agency of the town with all of the powers and duties authorized under I.C. 5-22.
      (2)   The Town Council shall designate in writing a person or persons to become the Town’s Purchasing Agent.
   (B)   The Purchasing Agency shall be authorized to purchase supplies with an estimated cost of less than $25,000 on the open market without inviting or receiving quotes or bids.
   (C)   The Purchasing Agency may purchase services not including supplies in whatever manner the purchaser determines to be reasonable.
   (D)   The Purchasing Agency and the Purchasing Agent shall specify in purchasing supplies that supplies purchased shall be manufactured in the United States unless:
      (1)   The supplies to be purchased are not manufactured in the United States.
      (2)   The price of the supplies manufactured in the United States exceed by an unreasonable amount the price of available and comparable supplies manufactured elsewhere.
      (3)   The quality of the supplies manufactured in the United States is substantially less than the quality of comparably priced available supplies manufactured elsewhere.
      (4)   The purchase of supplies manufactured in the United States is not in the public interest.
      (5)   The Purchasing Agency and the Purchasing Agent shall in all respects comply with I.C. 5-22.
