§ 54.08 COST.
   (A)   Pursuant to Indiana real property law, sidewalks are considered public right-of-way, however, the holder of the deed for the parcel adjacent to the sidewalk has legal title to the sidewalk and the strip of land abutting the street.
   (B)   The entire expense of excavating, or in any manner changing, the surface of any sidewalk, street, curb, alley or public place within the town shall be borne by the permittee. The town shall not be liable for any expenses incurred therefrom, nor for any injury or damages caused to any person or property.
