(A) Approval process.
(1) An industrial user holding a permit from the state shall file with the Public Works Department a copy of each report or application submitted to the state on the same day as it is filed with the state. Each industrial user who applies to the state for a permit shall similarly file a copy of the application and all supporting documents with the Public Works Department on the same day as it filed with the state.
(2) All industrial users must notify the Public Works Department before discharging to the sewage works. Information to be provided to the Public Works Department may be developed as part of a form, but, at a minimum, includes: construction plans, including all sewage works connections, description of activities at the facility, wastewater characteristics, a narrative description of any pretreatment of wastewaters, and detailed plans of any pretreatment system. The Public Works Department may require additional information or equipment.
(3) The Public Works Department will issue a letter to the user stating the discharge is approved within 30 days of receiving the submittal. Discharge approval will include the user following all sections of this chapter, and may include special conditions for discharging, monitoring and reporting. Obtaining a wastewater discharge approval does not relieve a permittee of its obligation to comply with all federal and state pretreatment standards or requirements, or with any other requirements of federal, state and local law.
(4) Discharge approval will be for a period of five years. Industrial users are required to submit information at least 90 days prior to permit expiration.
(5) Existing connections. Any industrial user required to obtain wastewater discharge approval, who was discharging wastewater into the sewage works prior to the effective date of this chapter, and who wishes to continue such discharges in the future, shall, within 60 days after that date, apply to the Public Works Department for wastewater discharge approval in accordance with this chapter, and shall not cause or allow discharges to the sewage works to continue after 180 days of the effective date of this chapter, except in accordance with written approval issued by the Public Works Department.
(6) New connections. Any industrial user required to obtain wastewater discharge approval from the Public Works Department, who proposes to begin or recommence discharging into the sewage works, must obtain such approval prior to the beginning or recommencing of the discharge. The wastewater discharge approval process must be completed at least 90 days prior to the date upon which any discharge will begin or recommence.
(B) Discharge approval fees.
(1) Discharge approval fees for users is specified in the town’s utilities fee schedule.
(2) As necessary, the Public Works Department may engage outside consultation to review submittals and plans. The user shall agree to pay the Public Works Department for the actual costs it incurred in its review of all submittals, plans and accompanying information.
(C) Discharge approval modification. The Public Works Department may modify an industrial user’s discharge approval for good cause, including, but not limited to, incorporating new limits or standards, changes to system operations, or changes to the user’s discharge.
(D) Discharge approval revocation. The Public Works Department may modify an industrial user’s discharge approval for good cause, including, but not limited to, failures to notify the Public Works Department per this chapter, misrepresentation of discharge, tampering with equipment, failure to meet limits, failure to pay fines or sewer charges, or failure to complete requested or required documentation by the Public Works Department.
