PENDING ORDINANCES
ORDINANCE NO.  SWO 2019-2
AN ORDINANCE AMENDING TITLE 5, CHAPTER 4, “RATES AND CHARGES”, SECTION 5-4-4Q,  “BILLING AND PAYING FOR SERVICES”,
OF THE LEYDEN TOWN CODE

   WHEREAS, in 2012, the corporate authorities of Leyden Township determined that large uncollectible delinquencies distorted the financial reporting of the combined sewer and water system; and
   WHEREAS, in 2012, the corporate authorities determined that said delinquent accounts should be reduced is the account balance was in excess of $15,000.00; and
   WHEREAS, since 2012, the delinquent account balances have grown substantially; and 
   WHEREAS, the Town Supervisor and the Board of Trustees of the Town of Leyden have determined that in order to reflect undistorted financial reporting, the delinquent account balances of properties served by the combined sewer and water system should be readjusted to further reduce said delinquent account balances.
   NOW, THEREFORE, BE IT ORDAINED BY THE SUPERVISOR AND BOARD OF TRUSTEES OF THE TOWN OF LEYDEN, COOK COUNTY, ILLINOIS, as follows:
   SECTION 1:   Title 5, Chapter 4, “Rates and Chares”, Section 5-4-4Q, “Billing and Paying for Services”, of the Leyden Town Code, as amended, is hereby further amended to read as follows:
5-4-4:   BILLING AND PAYING FOR SERVICES:
Q.   Accounting Directive:    The corporate authorities of Leyden Township have determined    that the compounding of user charges, penalties and delinquent charges imposed on vacant    properties pursuant to this code during sever economic downturn of recent years has    resulted in unanticipated large delinquent accounts due to the township, which    delinquencies may adversely affect the marketability of such vacant parcels, and which    may in turn adversely affect the value of neighboring properties. Having further determined    that large uncollectible delinquencies distort the financial reporting of the combined    system, the board of trustees do hereby authorize and direct the superintendent and    treasurer of the combined system to reduce and mark down the delinquent account balances    of properties served by the combined system as follows:
   1.   All residential and municipal rate customer accounts with a delinquent account          balance in excess of sixty-five thousand dollars ($65,000.00) as of the end of the          billing period terminating on or before April 30, 2019, and which: a) have been          vacant and unoccupied for more than six (6) months; b) are not consuming any          water as determined by the most recent meter reading, shall be reduced and restated       as having an outstanding account balance of fifty thousand dollars ($50,000.00) as       of May 1, 2019.
   2.   All commercial rate customer accounts with a delinquent account balance in excess       of sixty-five thousand dollars ($65,000.00) as of the end of the billing period          terminating on or before April 30, 2019, and which: a) have been vacant and          unoccupied for more than six (6) months; b) are not consuming any water as          determined by the most recent meter reading, shall be reduced and restated as          having    an outstanding account balance of fifty thousand dollars ($50,000.00) as of       May 1, 2019.
      Notwithstanding subsection 5-4-3J of this chapter, the superintendent is authorized       to adjust and compromise the amount required to satisfy the delinquent accounts          described in this subsection, provided that any adjustment in excess of two thousand       five hundred dollars ($2,500.00) shall be written concurrence of the supervisor, and       shall be reported to the township board of trustees.
   SECTION 2:   The provisions of this Ordinance shall be retroactive to May 1, 2019.
SECTION 3:    This Ordinance shall be in full force and effect from and after its passage and publication as provided by law
