(a) The violation of this chapter by any person under the age of 18 years shall constitute an act of delinquency and charges shall be filed hereunder with the Richland County Juvenile Court.
(b) Any parent or guardian who permits or neglects to restraint his child resulting in the violation of this chapter shall be guilty of a minor misdemeanor, and upon a second and subsequent violation within one year of the first, shall be guilty of a misdemeanor of the fourth degree.
