(a) No person being the owner or having charge of any dog shall fail to promptly pick up and properly dispose of any fecal matter left by his dog on any public or private property within this Municipality.
(b) Whoever violates this section is guilty of a minor misdemeanor and upon a second or subsequent conviction within one year of the first, shall be guilty of a misdemeanor of the fourth degree.
