If the owner, lessee, agent or tenant having charge of the lands mentioned in Section 919.02 fails to comply with the notice required by such section, the Village Administrator may do either or both of the following:
(a) Issue and serve in the manner provided in Criminal Rule 4 upon the owner, lessee, agent or tenant a complaint and warrant or summons to appear in the Lexington Mayor’s Court for a violation of Section 919.99;
(b) Cause the noxious weeds to be cut or destroyed or such litter removed and may employ the necessary independent contractor to perform this work or if Village employees are available upon request that the Village Administrator assign this work to employees of the Village. All expenses incurred shall be paid out of any money in the Village Treasury not otherwise appropriated.
