Abuse and/or mutilation of tree(s) in or on the "Tree Lawn", in or on the public right(s) of way, and in or on property owned by the Village of Lexington, Ohio:
(a) Unless specifically authorized by the Tree Commission, no person shall recklessly damage, cut, carve, deface, transplant or remove any "Street Tree(s)" in or on the "Tree Lawn," in or on the public right(s) of way, or any tree(s) in or on property owned by the Village of Lexington, Ohio.
(b) Unless specifically authorized by the Tree Commission, no person shall attach a rope, wire, nails, advertising posters or other contrivance to any "Street Tree(s)" in or on the "Tree Lawn", in or on the public right(s) of way, or in or on property owned by the Village of Lexington, Ohio. (Items put up by the Village are exempt.)
(c) No person shall allow any liquid or solid substance which is harmful to come into contact with "Street Tree(s)" in or on the "Tree Lawn", in or on the public right(s) of way, or trees in or on property owned by the Village of Lexington, Ohio.
(d) No person shall set fire or permit any fire to burn when such fire or heat therefrom will injure any "Street Tree(s)" in or on the "Tree Lawn", in or on the public right(s) of way, or trees in or on property owned by the Village of Lexington, Ohio.
(e) Whoever violates this section is guilty of a fourth degree misdemeanor punishable by a fine of not more than Two Hundred and Fifty Dollars ($250.00) and imprisonment for not more than thirty (30) days, and is liable in treble damages for the injury caused. If the property can be restored substantially to its former condition, damages shall be the reasonable cost of restoring the property. If the property cannot be restored substantially to its former condition, damages shall be the cost of replacing the "Street Tree(s)" with like kind and quality.
