155.05 POWERS AND DUTIES OF THE TREE COMMISSION.
   (a)   The Tree Commission shall have the power to study, investigate, plan, advise, report and recommend to Council or the Mayor, any action, program, plan or legislation which the Tree Commission shall find or determine to be necessary or advisable for the pruning, trimming, planting, replanting, maintenance, care, preservation, removal, and disposition of "street tree(s)" in or on the "tree lawn," in or on the public right(s) of way, and in or on property owned by the Village of Lexington, Ohio.
   (b)   The Tree Commission shall have the authority and jurisdiction for planning and scheduling the planting, replanting, maintenance, care, preservation, removal, and disposition of "street tree(s)" in or on the "tree lawn," in or on public right(s) of way, and in or on property owned by the Village of Lexington, Ohio, to insure safety and/or preserve the aesthetics of such public sites, and in conformity with any plans specifying species, size and location of "street tree(s)."
   (c)   The regularly scheduled meetings of the Tree Commission shall be as follows:
      (1)    The 1st Tuesday of January, March, May, July, September, and November at 7:30 p.m., in Council Chambers located at the Lexington Municipal Building.
   (d)   Authority to call a "special" meeting of the Tree Commission shall be vested in:
        (1)    The Mayor of the Village of Lexington, Ohio, and
      (2)    Chairman of the Tree Commission.
   (e)   For the Tree Commission to recommend a plan or regulation, there must be a majority vote of members of the Tree Commission for any ordinance to be presented to Council, and there must be majority of the members of the Tree Commission present before any business can be conducted at the regularly scheduled meeting of the Tree Commission and/or special meetings of the Tree Commission called by the Mayor or Chairman of the Tree Commission.
