1349.02 PERMITTING DUMPING OF REFUSE.
   (a)   No person shall dump, cause to be dumped, or permit to be dumped on any publicly or privately owned land or water within this Village any garbage, wood or wood products, paper, cardboard, scrap metal or metal products, liquid or semi-liquid products, or other scrap or waste materials of any nature whatsoever except those specified in division (b) below.
   (b)   No person shall dump, cause to be dumped, or permit to be dumped on any publicly or privately owned land or water within this Village any earth, stone, bricks, broken concrete, broken asphalt, and similar nonorganic materials unless there has previously been issued to the landowner where the dumping shall occur a permit which remains in full force and effect as provided in this section.
   (c)   Any person desiring to allow dumping upon land owned by him shall first obtain a permit from the Village Administrative Director. The permit shall be issued only upon the following terms and conditions which shall br brought to the attention of the applicant and shall constitute conditions upon which the permit is issued.
      (1)   The application shall contain the name and address of the applicant and a description of the land where the dumping is to occur.
      (2)   No materials other than those specified in division (b) above shall be dumped.
      (3)   The property owner shall be responsible for grading to an elevation compatible with adjoining land at least once each month.
      (4)   The property owner shall be responsible for controlling the type of material dumped on his property and shall immediately remove material that is not allowed under division (b) above.
      (5)   The property owner shall neither change nor permit to be changed the elevation of the land in such a manner as will increase the risk of flooding of adjoining land or shall make adequate provision for surface water runoff.
      (6)   The property owner shall post within the Village a surety bond, certified or cashier’s check, or cash in the sum of $500.00 to guarantee the faithful performance of his duties under this section. In the event of a failure to perform these duties, the Village may perform the same and charge the cost thereof against the bond. At the expiration of the dumping permit, the bond or part thereof remaining shall be refunded to the property owner.
      (7)   A permit issued under this section, unless revoked for violation of its terms, shall be valid for a period of one year.
      (8)   The fee for each permit shall be $10.00.
   (d)   Should the Village Administrative Director determine that any of the provisions of a permit are being violated, he shall give notice to the permit holder to correct the same. Should the violation not be corrected in a reasonable period of time not to exceed five workdays, the permit shall be revoked.
   (e)   Any landowner who permits or allows his land to be used for dumping or fails to take reasonable steps including the posting of signs or erecting a fence to prevent dumping shall be subject to the provisions of this section.
   (f)   This provision shall apply only to dumping which is intended to raise the level of the ground and not to that which is incidental to agriculture or landscaping purposes and does not result in a significant change in the topography of the property.
