(a) Scope. Effective immediately the following rules shall govern the operation of the Water Department of the Municipality of Lexington and all prior rules are hereby repealed.
(b) Definitions. As used in these rules, the following definitions shall apply:
(1) "Customer" means any person or entity who enters into an agreement with the Municipality to pay for water service to a unit.
(2) "Consumer" means any head of household or entity who occupies a unit to which water service is provided by the Municipality.
(3) "Water service" means water service provided by the Municipality for consumption.
(4) "Water service account" means an account for water services established with the Utilities Department.
(5) "Municipality" means the Municipality of Lexington, including its departments and employees.
(6) "Serve(d)" or "service", when used to refer to the service of bills, notices or decisions, means the use of first class mail, or personal delivery to a person of suitable age and discretion residing in the unit. "Service date" means the date on which such a bill, notice or decision was personally delivered or three days after such bill, notice or decision was mailed.
(7) "Request a hearing" means mailing a written request for a hearing to the Water Department of the Municipality, or making an oral or written request for a hearing to an employee of the Water Department at the offices of the Municipality.
