5-1-5: KENNELS 1 :
   A.   Defined: Any person owning, keeping, harboring or maintaining three (3) or more dogs, over the age of six (6) months old, shall be considered to be operating a dog kennel. (Ord. 00-02, 5-24-2000; amd. 2002 Code)
   B.   Applicability Of Land Use Regulations: A dog kennel shall only be operated in those zones where designated and allowed in the City land use ordinance, and may be operated only after a conditional use permit relating to each kennel is obtained in accordance with the provisions and regulations of the City land use ordinance. Application for the conditional use permit shall be made as required by the City land use ordinance and each application shall be approved or denied and each existing conditional use permit shall be renewed or subject to nonrenewal and revocation as provided in the City land use ordinance 2 .    C.   Permits Required: No person shall operate or maintain a dog kennel without first obtaining the required conditional use permit and then a license from the animal control officer.
   D.   Application For License; Inspection Of Premises: All applications to the animal control officer for a license to operate or maintain a dog kennel shall be submitted in writing, and shall have a copy of the applicant's conditional use permit attached to it. The premises shall be inspected by a designated City officer, and upon its approval, the animal control officer shall issue a license upon payment of the fee hereinafter provided.
   E.   Kennel License Fee:
      1.   Any person conducting, operating or maintaining a dog kennel shall pay to the City for the privilege of conducting, operating or maintaining such kennel an annual fee in such amount as established by resolution of the City Council.
      2.   The kennel license fee herein required may be changed from time to time by resolution of the City Council.
   F.   Rules Established: The City Council may promulgate rules and regulations covering the conduct and operation of all kennels within the City by resolution.
   G.   Violation; Revocation: Whenever the City finds or discovers a violation by a license holder of any rule or regulation either of the City or of the State, it shall upon receipt of such notice immediately notify the owner or keeper of such kennel to appear before the City Council at a day and time certain to show cause why the kennel license for such person should not be revoked for such violation.
