5-1-13: IMPOUNDING:
   A.   Redemption, Sale Or Disposition Of Impounded Animals:
      1.   Any dog impounded as registered or unregistered dog may be redeemed and taken from such pound by the owner thereof or by any authorized person by exhibiting to the animal control officer or person in charge of the pound, a certificate of registry as provided herein showing that the license fee for the current year has been paid and upon paying the person in charge of the pound an impounding fee in such amount as set by resolution of the city council and a sum to be set by the city council for each and every day such dog shall have been impounded to defer the costs incurred. In the case of an unregistered dog which has not been vaccinated as specified in this chapter, such vaccination shall be done and such dog shall be registered before being released from the pound. All impounded dogs or other animals not redeemed within three (3) days shall be sold for the best price obtainable at either public or private sale. Before any dog is released to the buyers, such dog shall be registered as herein provided and shall be vaccinated at the buyer's expense. All monies received from such sales shall be made to the city. All dogs or other animals that are not sold or redeemed in the required time shall be destroyed in a humane manner or released for experimental purposes as provided by law.
      2.   Any impounded dog which in the judgment of the animal control officer is suffering from any disease shall not be released except upon approval of a qualified licensed veterinarian in accordance with state law. (1980 Code § 13-247; amd. 2002 Code)
   B.   Unlawful Destruction: It shall be unlawful for the animal control officer or other city officials to destroy, cause or allow to be destroyed any dog or other animal impounded and registered with the animal control officer or city until the expiration of the impounding limit of three (3) days except:
      1.   In the case the animal control officer impounds or receives a dog or other animal injured or which has a contagious disease other than rabies and upon recommendation of a qualified licensed veterinarian, he may destroy the animal.
      2.   As provided by subsection 5-1-7D of this chapter, or as otherwise provided by state law. (1980 Code § 13-252)
