§ 90.02 FIRE CHIEF MAY ISSUE PERMISSION TO BURN.
   Upon application by the owner or occupant of any real property in the city upon which is located any debris or any other similar material which cannot be disposed of reasonably other than by burning, the Chief of the Fire Department or his designee may issue permission to the applicant authorizing the burning of such debris or other similar material on said real estate, subject to the provisions hereinafter set forth:
   (A)   Such permission shall be issued only after a determination by the issuer that such burning shall not endanger life or property and shall not constitute a public nuisance.
   (B)   Such permission shall set forth the name of the person or entity to whom the permit is issued, the address of the real property and shall prescribe the time of burning and any conditions, which in the determination of the issuer, are necessary to protect life and property and avoid any public nuisance.
   (C)   If in the determination of the Chief of the Fire Department or his designee a burning for which permission has been issued hereunder shall endanger life or property or shall become or constitute a public nuisance, the Chief or his designee may revoke such permission immediately and such fire shall be immediately extinguished by the applicant.
