§ 70.07 UNCLASSIFIED VIOLATIONS.
   (A)   No person shall operate any motor vehicle with unnecessary exhibition of speed on any public or private property or way within the city limits, except when an emergency creates the necessity for the operation. Prima facie evidence of the unnecessary exhibition of speed shall be any or all of the following:
      (1)   Unreasonable squealing or screeching sounds emitted by the tires;
      (2)   The throwing of sand or gravel by the tires of the vehicle; and/or
      (3)   Unreasonable skid, sway or slide upon acceleration or stopping.
   (B)   No person shall operate any motor vehicle in a manner which causes excessive or unusual exhaust noise or backfire. Prima facie evidence of excessive exhaust noise shall be the equipping or maintenance of a motor vehicle exhaust system that shall emit or produce a sharp popping or crackling sound or other excessive or unusual noise. Every motor vehicle shall at all times be equipped with a muffler or exhaust system in good working order which blends the exhaust noise into the overall vehicle noise and is in constant operation to prevent excessive or unusual noise. No person shall use a muffler cutout, by-pass or similar device upon any motor vehicle.
   (C)   Any violation of any of the provisions of this section shall be punishable as a petty misdemeanor as defined by the state statutes.
