§ 152.093 DISTRICT INTENT, PERMITTED USES, AND SPECIAL EXCEPTION USES.
   (A)    District intent.
      (1)   This overlay district can only be used over districts with small lots to enable medium to large scale business developments to occur as appropriate for the community. To allow these medium to large business developments to occur, the developer must assemble multiple residential small lots. This is required in order to prevent conflicting land uses or adverse effects to adjacent residential property owners.
      (2)   To qualify for the Conversion District Overlay, the developer must meet the regulations of this Overlay District.
      (3)   The Plan Commission and BZA should strive to disallow development proposals that leave stray residential properties or that are deemed conflicting land uses. Further, appropriate buffering should be required.
      (4)   All development proposals for the Conversion District Overlay are contingent on Plan Commission approval after at least one public hearing.
   (B)   Permitted uses.
      (1)   As a primary zoning district. Residential properties within this Overlay District shall continue to be regulated by the permitted uses of the primary zoning district.
      (2)   As a conversion district overlay. The following business uses are permitted uses once all lot and building standards set forth in this subchapter have been met:
         (a)   Auto sales/service.
            1.   Auto parts;
            2.   Auto sales;
            3.   Auto wash;
            4.   Gas station;
            5.   Oil change service.
         (b)   Business: food sales /service.
            1.   Bakery retail;
            2.   Convenience store;
            3.   Delicatessen;
            4.   Grocery/supermarket;
            5.   Restaurant.
         (c)   Business: general business.
            1.   ATM machine;
            2.   Insurance;
            3.   Real estate;
            4.   Travel.
         (d)   Business: office/professional.
            1.   Bank/credit union;
            2.   Medical clinic.
         (e)   Business: personal service.
            1.   Beauty salon;
            2.   Tanning salon.
         (f)   Business: recreation.
            1.   Theater, indoor;
            2.   Video store.
         (g)   Business: retail.
            1.   Apparel shop;
            2.   Book shop;
            3.   Drugstore;
            4.   Fabric shop;
            5.   Floor coverings;
            6.   Flower shop;
            7.   Furniture store;
            8.   Gift shop;
            9.   Hardware store;
            10.   Home electronics/appliance store;
            11.   Music shop;
            12.   Office supplies;
            13.   Paint store;
            14.   Sporting goods.
   (C)   Special exception uses.
      (1)   As a primary zoning district. Residential properties within this overlay district shall continue to be regulated by the special exceptions of the primary zoning district.
      (2)   As a conversion district overlay. The following business uses are special exception uses once all lot and building standards set forth in this subchapter have been met:
         (a)   Business: food sales /service.
            1.   Drive-in restaurant;
            2.   Farmer's market;
            3.   Roadside stand.
         (b)   Business: personal service.
            1.   Daycare;
            2.   Dry-cleaning service;
            3.   Fitness center/gym;
            4.   Health spa.
         (c)   Business: recreation.
            1.   Bowling alley;
            2.   Lodge/private club.
