§ 152.060 NC DISTRICT.
   (A)   NC District intent, permitted uses, and special exception uses.
      (1)   District intent.
         (a)   The NC (Neighborhood Commercial) District is intended to provide a land use category for small scale commercial uses that provide products and services to neighborhoods. The provisions that regulate this land use district should promote appropriate commercial uses that are clearly nonconflicting with neighborhoods in the town.
         (b)   The Plan Commission and Board of Zoning Appeals should strive to use this district sparingly and appropriately as needed in the community.
         (c)   The Plan Commission and Board of Zoning Appeals should also strive to exclude businesses from the NC District that are not family oriented or that have an adverse effect on the existing or future adjacent neighborhoods.
      (2)   Permitted uses.
         (a)   Business: retail.
            1.   Drug store;
            2.   Flower shop;
            3.   News dealer/bookstore.
         (b)   Business: auto sales/services.
            1.   Auto sales/service.
         (c)   Business: food sales/service.
            1.   Bakery, retail;
            2.   Convenience store;
            3.   Delicatessen;
            4.   Grocery/supermarket.
         (d)   Business: personal service.
            1.   Barber/beauty shop;
            2.   Day care;
            3.   Fitness center/gym.
         (e)   Business: recreation.
            1.   Video store.
         (f)   Business: office/professional.
            1.   Bank machine/ATM.
         (g)   Institutional/public facilities.
            1.   Public park/recreation center;
            2.   Accessory use structure.
      (3)   Special exception uses.
         (a)   Residential.
            1.   Dwelling, single-family (upper stories);
            2.   Dwelling, multifamily, (upper stories).
         (b)   Institutional/public facilities.
            1.   Church, temple or mosque;
            2.   Community center;
            3.   Government office;
            4.   Library;
            5.   Police/fire station;
            6.   Post office;
            7.   Recycling collection point;
            8.   School, public/private.
         (c)   Communication/utility.
            1.   Telephone exchange;
            2.   Utility substation.
            3.   Public well.

Minimum Lot Area:
• 7,000 square feet
Minimum Lot Width:
• 60 feet
Minimum Lot Frontage:
• 60 feet on a Public Street with access from said Public Street
Minimum Front Yard:
• 20 feet when adjacent to a Primary Arterial Road
• 20 feet when adjacent to a Secondary Arterial Road
• 20 feet when adjacent to a Collector Road
• 20 feet when adjacent to a Local Road
Minimum Side Yard:
• 15 feet (plus buffer yard)
(0 feet if neighboring yard is commercial)
Minimum Rear Yard:
• 15 feet for the Primary and Accessory Structures (plus buffer yard)
 
Maximum Structure Height:
• 35 feet for the Primary Structure, from the grade at the front entrance
• 15 feet for Accessory Structures
