§ 152.044 R5 DISTRICT.
   (A)   R5 District intent, permitted uses, and special exception uses.
      (1)   District intent.
         (a)   The R5 District, Multifamily Residential, is intended to provide a land use category for small to medium scale multifamily developments. The provisions that regulate this land use district should protect, promote and maintain areas in the town for existing and future multifamily housing growth.
         (b)   The Plan Commission and Board of Zoning Appeals should strive to use this district as a buffer between other residential districts, and the NC, OC, DC, C1, and C2 Commercial Districts. This district should be within close proximity to parks, open space, services and retail if possible. Avoid locating near conflicting land uses.
      (2)   Permitted uses.
         (a)   Residential.
            1.   Dwelling, multifamily;
            2.   Dwelling, multifamily, duplex;
            3.   Dwelling, multifamily, apartment;
            4.   Accessory structure;
            5.   Decks attached or free standing;
            6.   Private swimming pools;
            7.   Nursing home;
            8.   Retirement community;
            9.   Home occupation.
         (b)   Institutional/public facilities.
            1.   Public park/recreation center;
            2.   Church, temple or mosque;
            3.   Cemetery;
            4.    Community center;
            5.    Fire station;
            6.    Government office;
            7.    Library;
            8.    Police station;
            9.    Post office;
            10.     School, public/privat e.
      (3 )     Special exception uses.
         (a)   Communication/utilities.
            1.   Cellular/communication/radio/television tower;
            2.   Pipeline pumping station;
            3.   Public wells;
            4.   Telephone exchange;
            5.   Utility substation.
         (b)   Miscellaneous.
            1.   Artificial lake.

Minimum Lot Per Family:
• 8 500 square feet
Minimum Lot Width:
• 200 feet
Minimum Lot Frontage:
• 100 feet on a Public Street with access from said Public Street
Minimum Front Yard:
• 60 feet when adjacent to a Primary Arterial Road
• 50 feet when adjacent to a Secondary Arterial Road
• 50 feet when adjacent to a Collector Road
• 50 feet when adjacent to a Local Road
Minimum Side Yard:
• 25 feet
Minimum Rear Yard:
• 30 feet for the Primary Structure
• 20 feet for Accessory Structures
 
Minimum Structure Height:
• 40 feet for the primary structure, from the grade at the front entrance
• 20 feet for Accessory Structures
