Upon request of the village and within thirty (30) days thereof, and prior to receiving a dedication of land or a cash contribution in lieu of land pursuant to this chapter, the school district shall execute an intergovernmental agreement with the village in which the school district agrees to indemnify and hold the village harmless, including all associated costs and reasonable attorney fees incident to any suits filed in which the validity or application of any section of this chapter is challenged. The selection of counsel to defend any such action shall be by the mutual agreement and consent of the village and the school district. (Ord. 26-96, 8-6-1996)
