5-7-3: PERMITTED BURNING:
The following activities are not in violation of this chapter:
   A.   Landscape Waste: The open burning of landscape waste shall be allowed in the village; provided, that the following requirements are met:
      1.   Burning shall take place only on the premises on which said waste is generated and not upon any village streets, alleys, or rights of way.
      2.   The burning shall be located no closer than twenty feet (20') from any building, structure, tree, brush, or shrub.
      3.   The burning shall at all times be attended by a responsible individual and kept under appropriate control. (Ord. 17-95, 9-5-1995)
      4.   The burning shall take place only between the hours of four o'clock (4:00) P.M. and seven o'clock (7:00) P.M., Monday through Friday, and from twelve o'clock (12:00) noon through six o'clock (6:00) P.M., Saturday and Sunday, subject to the condition that no burning be conducted when wind, drought, or atmospheric condition creates a potential fire hazard or nuisance or creates a visibility hazard on roadways, railroad tracks or air fields.       5.   The mayor may from time to time declare the existence of a period of drought conditions during which all burning of landscape waste shall be prohibited. The prohibition against the burning of landscape waste during drought conditions shall commence twenty four (24) hours after the declaration thereof by the mayor and shall terminate upon the declaration by the mayor that such drought conditions cease to exist.
   B.   Cooking And Recreation: Nothing in this chapter shall be deemed to prohibit the use of wood or charcoal in stoves or other apparatus used for cooking or for recreation. (Ord. 17-95, 9-5-1995)
