8-2-2: FENCE AND BARRIER REQUIREMENTS:
All outdoor private residential swimming pools, except those pools having walls extending forty two inches (42") high or higher, above ground level, shall be completely enclosed by a fence, wall or other effective barrier. All openings in a fence, wall or other barrier shall be equipped with a gate. The required fence, wall or gate(s) must be at least four feet (4') high, measured on the inside and the outside, and shall not provide ready footing for climbing. All gates shall be self-closing or self-latching, and shall be locked when the pool is not in use. The device for operating the gate's self-closing or self-latching mechanism shall be located at least forty two inches (42") above the bottom of the gate. No opening in the fence, wall, gate or other barrier shall exceed three inches (3") in width. No opening at the bottom of the fence, wall, gate or other barrier shall exceed three inches (3") in height. A rigid cover, when used with a hot tub or spa, shall be an acceptable substitute for a fence, wall or other barrier. (Ord. 296, 3-27-1995; amd. 2008 Code)
