7-2-5: DEPOSIT AND FEE:
   A.   Payment Required; Fee Amounts: Before a permit is issued, the permit applicant shall make a payment which shall consist of a refundable deposit in the amount of the city engineer's estimate and a nonrefundable fee based on the following schedule:
 
Streets or alleys constructed of a Portland cement, concrete or bituminous concrete surface
 
$150.00 per opening
Streets or alleys constructed of a bituminous surface treatment
 
100.00 per opening
Streets or alleys constructed of an earthen surface or an aggregate surface
 
50.00 per opening
Sidewalks
 
25.00 per opening
Excavations parallel to or along any street or alley, extending diagonally into, through, or across any street or alley
 
500.00
For excavations in the course of a major change or improvement, the fee structure under section 7-2-6 of this chapter shall apply.
 
   B.   Refunds: The permit applicant's payment shall be promptly delivered to the city treasurer, who shall not be required to hold it in an interest bearing account. The refundable portion of any such payment shall be refunded to a permit holder only after the city engineer determines that the surface has been restored to a condition equal to or better than what existed prior to excavation. If the restoration is unsatisfactory or is not completed within a reasonable time, the refundable portion of such payment shall be applied to such restoration. (Ord. 298, 4-25-1995)
