§ 119.42  SCOPE.
   (A)   This subchapter shall apply to the manufacture and sale of malt beverages, wine and distilled spirits on any premises or establishment within the city. The manufacture and/or sale of malt beverages, wine and distilled spirits on any premises or establishment within the city pursuant to a license issued by the Department of Alcoholic Beverage Control Board shall be governed by the applicable state statutes; however, the provisions of this subchapter shall apply to all persons, licensees, premises and establishments within the city to the fullest extent such application is delegated to the city, or otherwise authorized, by the provisions of KRS Ch. 241 through 244.  Nothing in this subchapter shall excuse or relieve the licensee, or the agent or any employee of any licensee thereof, from the restrictions, requirements and penalties of any other ordinance or ordinances of the city or of any statutes of the Commonwealth relating to violations pertaining to alcoholic beverages.
   (B)   The provisions of the Alcoholic Beverage Control Law of the Commonwealth (KRS Chapters 241, 242, 243 and 244) and all amendments and supplements thereto, are adopted so far as applicable to this subchapter, except as otherwise lawfully provided herein.
