§ 153.075 ESTABLISHED; MEMBERS; TERM; VACANCIES.
   (A)   A Board of Adjustments is hereby established in accordance with Kentucky Revised Statutes, Chapter 100.
   (B)   (1)   There shall be five (5) citizen members approved by the City Council and appointed by the Mayor for four (4) year terms ending on the first month of the designated year.
      (2)   The terms shall be staggered so that the terms of no more than two (2) members expire in any year.
   (C)   (1)   Vacancies on the Board shall be filled within sixty (60) days.
      (2)   If the vacancy is not filled at that time, the Commission shall fill the vacancy.
      (3)   When a vacancy occurs other than through expiration of the term of office, it shall be filled for the remainder of that term.
   (D)   Board of Adjustments members must meet a minimum of one (1) of the following:
      (1)   Reside within the corporate limits of the city;
      (2)   Own and/or operate a business for profit within the corporate limits of the city and reside within the county;
      (3)   Own real estate within the corporate limits of the city and reside within the county.
   (E)   At least two-thirds () of the members of the Board of Adjustments shall reside within the corporate limits of the city.
   (F)   Officers of the Board of Adjustments shall consist of a chairman, vice-chairman and secretary-treasurer, only one (1) of whom can reside outside of the corporate limits of the city.
