§ 150.26 DIRECTOR TO INSPECT ENCROACHMENTS FOR OBSTRUCTION OF WATER FLOW; DETERMINATIONS.
   (A)   The Public Works Director of the city shall inspect all structures and all changes in the contour of real property which encroach upon or result in the encroachment upon any public right-of-way within the city so as to assure that no obstruction of the flow and/or drainage of water along the said public right-of-way has been created.
   (B)   Upon a determination by the Public Works Director that no encroachment which impedes the flowage of water along a public right-of-way has occurred, he shall certify his approval to the owner of the affected property in writing.
   (C)   Upon a determination by the Public Works Director that an encroachment which impedes the flow of water along a public right-of-way has occurred, he shall inform the owner of the affected property who shall remove the encroachment within ten days of such notification. The failure to remove the encroachment within ten days of such notification shall be deemed a public nuisance.
