§ 63.01 OBSTRUCTION OF UTILITY FIXTURES.
   (A)   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   FIXTURES. Those parts of the utilities system designed and meant to be readily accessible for control, maintenance, and operation of the utilities system, including but not limited to manholes, valves and meters.
   OBSTRUCTION. Any natural or manmade object which interferes with the immediate access to fixtures of the utilities system.
   PERSON. An individual or any other legal entity.
   UTILITY SYSTEM. The combined operation of the natural gas, water and sewer utilities belonging to the city.
   (B)   It shall be unlawful for any person to cause or permit an obstruction of a fixture whether it be by allowing the growth of natural plant life or by construction of buildings, streets, driveways or any other such manmade objects.
   (C)   The Superintendent of Public Utilities shall cause each such obstruction that is brought to his attention to be immediately removed and the cost thereof is charged to the persons responsible for the obstruction.
   (D)   Any person in violation of the provisions of this section shall be liable to the city for the cost of removing any obstruction and the repair for damage to a fixture, if any.
