The failure of the city at any time to require performance by any franchisee under the provision of the franchise shall in no way affect the right of the said city thereafter to enforce same. Nor shall waiver by the said city of any breach of any provisions hereof constitute a waiver of any succeeding breach of the provision or as a waiver of any provision itself.
