The rates chargeable for the pickup services shall be as follows:
(A) For non-commercial users, the rate for solid waste pickup which is available shall be eighteen dollars and fifty cents ($18.50) per month for city residents and twenty-three dollars and ten cents ($23.10) per month for non-city residents. NON-COMMERCIAL USERS are defined as those whose refuse primarily consists of solid waste generated by personal, family or household activities. Provided however, for non-commercial users who meet the following criteria the rate shall be thirteen dollars and seventy-five cents ($13.75) per month, which criteria are as follows:
(1) The customer or the customer’s spouse must have attained the age of sixty-five (65) years and reside within the city limits, and he or she must be the owner or tenant of the premises from which solid waste is to be removed and occupy the premises as the principal place of residence.
(2) The service must be billed in the name of the resident or his or her spouse who has attained age sixty-five (65) years.
(3) The premises must be used only for residential purposes.
(4) In order to effectuate the reduced rate, application must be made at City Hall along with proof of age.
(B) For users who operate small businesses at their principal place of residence and whose refuse contains both non-commercial and commercial waste, the rate for solid waste pickup shall be a minimum of thirty dollars and eighty cents ($30.80) per month. Provided, however, should the volume generated by such users exceed one (1) yard per week, the standard commercial rates as set forth in division (C) below shall apply.
(C) Rates for commercial solid waste pickup service shall be as follows:

(D) For those commercial customers who request and receive regular solid waste pickup services on week-ends, the following charges for such services will be assessed, which charges are in addition to the regular monthly charges.

(E) Businesses having more than two (2) yards per pickup shall use a dumpster.
(F) Residents of the city may deliver to the city operated transfer station, at no additional charge, non-commercial solid waste generated at their residence which consists of yard waste, cardboard and other acceptable bulky items not normally collected at curb-side. Does not include construction/ demolition debris.
(G) The above revised rates shall become effective July 1, 2013. Thereafter, all rates shall automatically increase ten percent (10%) per annum for each of the next three fiscal years. Thereafter, the rates will be adjusted in an amount equal to the percentage of increase plus one-half of one percent, which the city receives from it then provider of solid waste transport and disposal facility. The service rates for residential properties, non-commercial and commercial properties containing pickup for two (2) yards or less shall not increase for the 2023 fiscal year beginning July 1, 2023. The service rates shall be reviewed prior to July 1, 2024.
(H) (1) The above schedule and rates described in division (B) shall be temporarily reduced if a business conducted within an individual's home is required to cease operation by federal or state authority due to a declaration of emergency. In such an occasion an individual shall be charged by the rates and schedule in division (A).
(2) The above schedule and rates described in divisions (C) and (D) shall be temporarily waived if a commercial business is required to temporarily cease operation by federal or state authority due to a declaration of an emergency.
(3) If an individual or commercial business included in division (H)(1) and (H)(2) has paid for solid waste disposal during a time period their business was ordered to cease operations due to a declaration of an emergency, that individual or business shall be reimbursed for the amount paid upon written proof provided.
(4) For purposes of this section, an EMERGENCY can be defined as an occasion of urgency and suddenness where something needs to be done at once.
(5) A state of emergency must be declared by the City of Leitchfield by executive authority and legislative approval for the above cited change of rates to apply.
(I) In addition to the above listed schedule and rates for solid waste pick-up previously described there shall be an additional category for houses used primarily for religious worship and small businesses that generate minimal amounts of solid waste pick-up. The rate for users that meet the criteria shall be thirty-two dollars and forty-one cents ($32.41) per month. The following criteria must be met by the establishment to qualify under this category:
(1) The houses used primarily for religious worship or small business must operate within Leitchfield City limits.
(2) The houses used primarily for religious worship or small business must generate less than one-fifth (1/5) of one yard or thirty-four (34) gallons of solid waste pick-up.
(3) In order to qualify under this category rate an application must be completed and filed at Leitchfield City Hall.
