§ 38A.40 ENFORCEMENT OFFICER CREATED.
   (A) There is hereby created an Enforcement Officer who shall have the authorities, duties, and responsibilities as set forth in this chapter to enforce the provisions of this ordinance.
   (B)   The Enforcement Officer shall be appointed within sixty (60) days of the effective date of this chapter and his term shall be for a period of two (2) years beginning on January 1, 1995.
   (C)   The Enforcement Officer may be removed by the Mayor, subject to the approval of the City Council for misconduct, inability or willful neglect of duties. Before the Enforcement Officer is removed from office under this section, he shall be afforded the opportunity for a hearing before the Mayor and the City Council.
   (D)   A vacancy created by absence of the Enforcement Officer shall be filled within sixty (60) days by the Mayor, subject to the approval of the City Council. If a vacancy is not filled by the Mayor within sixty (60) days, the City Council shall fill the vacancy. All vacancies shall be filled for the remainder of the unexpired term.
   (E)   The Enforcement Officer shall be reimbursed for all necessary and reasonable expenses incurred in the performance of his duties and he shall be paid the customary hourly fee for services rendered.
