§ 112.04  ITINERANT MERCHANT LICENSE APPLICATION; BOND.
   (A)   Any person or persons, firm, or corporation desiring to engage in the business of itinerant merchant, as defined in § 112.01, within the village, shall make an application in writing to the mayor of the village at least 7 days before such applicant shall be authorized to begin such business.
   (B)   The application shall state the name and residence of the applicant, the place where the business is to be conducted, the kind of goods to be sold, and the length of time for which the license is to be desired.
   (C)   The application shall be accompanied by a bond in the penal sum of $500 executed by a surety company or two responsible freeholders residing within the village (or in lieu thereof a cash bond of equal amount) conditioned that all goods, wares, services, or merchandise or articles sold by the applicant will be as represented by him, and that he will refund the purchase price of any goods, wares, merchandise, or articles sold by him which are not as represented.  Any person aggrieved by the action of any itinerant merchant shall have the right of action on the bond for the recovery of money or damages or both.  In the event a cash bond is deposited, the same shall be retained by the village for 90 days after the expiration of any such license.
   (D)   Upon the filing of such bond with the mayor of the village, a license shall be issued by the mayor, to such applicant to begin business not less than 7 days after the date of filing such application and bond, upon the payment of the following fees:  for one day, $5; for one week, $30; for one month, $100.  All such license fees must be paid in advance and if any such licensee desires to continue in business after the expiration of such license, a new license must be secured in the same manner and upon the same terms as the original license.
   (E)   Any person exempted by the laws of the State of Ohio from the payment of any such license fee or fees, shall, before beginning such business, present to the mayor of the village his credentials, showing that he is entitled to such exemption, and shall execute and file a bond as provided and upon approval of the bond by the mayor. He shall then receive a certificate from the mayor authorizing him to engage in the business of itinerant merchant within the village for any period not longer than one month.  If at the end of a month the person desires to continue in such business, another certificate must be procured from the mayor.
