(D) Whoever violates § 72.49 shall be deemed guilty of a misdemeanor and shall be fined not more than $100 for the first offense thereof; and for a second offense within one year thereafter, not less than $50 nor more than $250; and for the third or subsequent offense within one year after the first offense shall be fined not less than $100 nor more than $500.
