§ 51.21 WASTEWATER STRENGTH LIMITS.
   Limitations are as follows.
   (A)   Categorical pretreatment standards. Categorical pretreatment standards shall be met by all dischargers regulated by such standards unless the locally established effluent limitations are more stringent.
   (B)   State requirements. State requirements and limitations on discharges to the wastewater utility shall be met by all users that are subject to such requirements and limitations in any instance in which they are more stringent than either a categorical pretreatment standard or a locally established effluent limitation.
   (C)   Right of revision. The town reserves the right to amend this section to provide for more stringent limitations on requirements on discharges to the sewer system where deemed necessary to comply with the objectives set forth in division (A) above.
   (D)   Dilution. Unless authorized to do so by an applicable pretreatment standard or requirement, no user may increase the use of process water or in any other way attempt to dilute a discharge as a partial or complete substitute for adequate treatment to achieve compliance with any applicable pretreatment standard or requirement. The town may impose mass limits on users that are using dilution to meet the applicable pretreatment standards or requirements or in any other case where mass limits are appropriate.
   (E)   Local effluent limitations. Users may not discharge into the sewer system any wastewater containing concentrations of pollutants greater than the following limits:

   (F)   Accidental discharge.
      (1)   Users shall immediately notify the town and the Warsaw wastewater utility of an upset, spill or other slug load that has a reasonable potential to cause a violation of any applicable pretreatment standard or requirement. The notification should provide the following information:
         (a)   The location, date and time of the discharge;
         (b)   The character and volume of the discharged or released material; and
         (c)   Any containment or corrective actions taken by the users.
      (2)   Within five days after the above described verbal notification has been made, the user will submit to the town and Warsaw wastewater utility a written report describing the cause of the discharge, the duration of the discharge and the measures to be taken by the user to prevent similar discharges in the future. This report shall contain the following certification statement: “I certify under penalty of law that this document and all attachments were prepared under my direction or supervision in accordance with a system designed to assure that qualified personnel properly gather and evaluate the information submitted. Based on my inquiry of the person or persons who manage the system or those persons directly responsible for gathering the information, the information submitted is, to the best of my knowledge and belief true, accurate, and complete. I am aware that there are significant penalties for submitting false information, including the possibility of fine and imprisonment for knowing violation.”
   (G)   Wastewater slug control plans. At the discretion of the town, users may be required to develop and submit a wastewater slug control plan (WSCP) that shall include, at a minimum:
      (1)   A description of discharge practices, including non-routine batch discharges;
      (2)   An identification of any stored chemicals and description of the way the chemicals are stored;
      (3)   Procedures for immediately notifying the town of slug load discharges, including any discharge that would violate a prohibition under § 51.18 of this chapter; and
      (4)   Procedures to prevent spills and to minimize their effect when they occur, including inspection and maintenance of storage areas, handling and transfer of materials, loading and unloading operations, control of plant site runoff, worker training, building of containment structures or equipment, measures for containing pollutants that would be toxic to the town or cause or contribute to pass through and/or interference, and measures and equipment for emergency response.
