If a property owner fails to remedy a situation covered under the Building Code or under agreements related to building and property regulations covered by various permits which direct a property owner to complete stated work within a stated period of time, the City Administrator may cause to have the work completed by the City with the costs assessed against the property owner in the following manner:
1. Notice. The City Administrator shall notify, by certified and registered mail, the property owner of the property owner’s failure to remedy a situation and give that property owner a reasonable amount of time to complete the necessary work.
2. Completion of Work. The City Administrator shall, after a reasonable amount of time, cause to have the work done by City workers or by private contractors.
3. Fee Schedule - City Workers. The Council shall establish, by resolution, the fees and other costs associated with the City’s abatement of any violation of any provision of this chapter as referenced herein.
4. Fee Schedule - Private Contractors. When, in the opinion of the City Administrator, it is desirable or necessary to have work done by private contractors, the property owner shall be billed at 125 percent of the charge from the private contractor to the City.
5. Assessment of Costs. The Clerk will certify the costs to the County Treasurer for assessment and the costs will then be collected with and in the same manner as property taxes.
6. Work Performed Under Emergency Situations. After reasonable attempts have been made to contact the affected property owner, either in person or by phone, and said property owner is either not contacted or consent is given to make the necessary repairs and bill them, only direct City costs shall be billed to the property owner. Equipment costs shall be billed on an hourly basis using standard rental rates in effect at the time as listed in the current Iowa DOT Schedule of Equipment Rates. (The provisions of this section do not apply to non-complying property owners after due notice has been served and as such all other provisions of this section shall apply thereto.)
