It shall be unlawful for any person to beat or wantonly or maliciously torture or injure any animal in any manner, or to neglect to provide adequate food, water and/or shelter for any animal in their care or under their control. No person may subject an animal to cruelty and shall be charged as a felony state law violation per SDCL 40-1-2.4.
