§ 156.999 PENALTY.
   (A)   It shall be unlawful for any person(s) to violate any provision or fail to comply with any of the requirements of this chapter. A violation of, or failure to comply with, any of the requirements of this chapter shall be deemed a misdemeanor and subject the violator to fines, penalties and orders for injunctive relief and shall be responsible for the city’s attorney’s fees and costs. Each day that such violation continues shall constitute a separate violation. Moreover, any person who violates any part of this chapter shall be responsible for any and all fines, penalties, damages and costs, including, but not limited to attorney’s fees and costs, incurred by the city for violation of federal and state environmental laws and regulations caused by or related to that person’s violation of this chapter; this responsibility shall be in addition to any penalties, fines or injunctive relief imposed under this chapter.
   (B)   Penalties shall be determined based on the sections of the ordinance that have been violated, but shall not be less than $150 and not more than $4,000 per day for each separate violation. Each day there is a violation of any part of this chapter shall constitute a separate offense.
   (C)   Any violation of this chapter is hereby classified as a civil offense pursuant to KRS 65.8808 and nothing herein or in §§ 39.01 et seq. shall prohibit the enforcement of the chapter by any other means authorized by law.
