Whenever this chapter sets forth a time period in which any act shall be performed, such time shall be deemed of the essence, and failure to perform within the allotted time shall be sufficient grounds to invoke the remedies available pursuant to § 113.99 or applicable law; provided, that either the grantee or the government may waive any time period by failing to provide written notification to the other of its intent to invoke such remedies within twelve (12) months after the occurrence of a failure to timely perform any act required by this chapter.
