For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
"ANIMAL CONTROL OFFICER." That individual, and his or her designees, who has been appointed as the Animal Control Officer for Anderson County by the Anderson County Fiscal Court pursuant to an agreement between the City of Lawrenceburg and Anderson Fiscal Court, as provided in § 90.25 of the Ordinances of the City of Lawrenceburg.
"OWNER." Any person owning, keeping, harboring, or having a property interest in a dog in Anderson County, Kentucky.
"POTENTIALLY VICIOUS DOG." A dog which poses a threat to the public safety as demonstrated by:
(1) Causing an injury to a person or domestic animal that is less severe than a serious injury as defined in this section;
(2) Without provocation, chasing or menacing a person or domestic animal in an aggressive manner;
(3) Running at large and impounded or whose owners have been cited by the Animal Control Officer two (2) or more times within any twelve (12) month period; or
(4) Acts in a highly aggressive manner within a fenced yard or enclosure and appears to a reasonable person able to escape from the yard or enclosure.
"PROPER ENCLOSURE." A secure confinement indoors or secure confinement in a locked enclosure at least seven (7) feet high or a locked kennel run with a secured top. Any enclosure or kennel shall be so constructed as to prevent escape by the dog and entry of young children. It shall also provide protection from the elements for the dog and be a minimum of seventy-two (72) square feet in area.
"RESPONSIBLE PERSON." A person at least eighteen (18) years old who is familiar with the dogs and is capable of keeping the dog under complete control at all times.
"SERIOUS INJURY." Any physical injury that results in broken bones or lacerations that require sutures.
"VICIOUS DOG." Any dog that:
(1) Causes a serious injury to a person or domestic animal; or
(2) Has been designated as a potentially vicious dog and engages in behavior that poses a threat to the public safety as described in this section under the definition of “potentially vicious dog”.
