(A) Backflow preventers defined in § 51.152 shall be tested at least annually by an individual certified by the Bluegrass Cross-Connection Program who may be a city employee or an independent contractor approved by the Public Works Director. Backflow preventers with a history of failure or located on premises where failure could constitute a serious threat to the public health may be inspected at more frequent intervals as determined by the Public Works Director.
(B) Testing shall be performed during the normal business hours of the city but may, at the request of the owner, be performed at a different time. Any additional costs relating to testing outside the city's normal business hours shall be borne by the owner.
(C) Any backflow preventer which fails during testing shall be repaired or replaced within thirty (30) days of the test. After the expiration for the thirty (30) day period, the city may retest the backflow preventer to determine compliance with this subchapter. If the backflow preventer has not been repaired or replaced, the Public Works Director shall issue a written order stating that, unless the owner has complied with the notice within five (5) days from receipt of the order, water service to the owner's premises shall be immediately terminated without further notice.
(D) Notwithstanding any other provisions of this subchapter or other ordinances of the city, if at any time the Public Works Director determines that the failure of a backflow preventer constitutes a serious threat to the public health, he may terminate water service to the premises immediately.
