(A) On and after the effective date of this subchapter, an owner intending to request that the city install a water meter shall provide the Public Works Director with construction plans and appropriate information relating to the use of the premises in sufficient detail for the Public Works Director to determine the type of backflow preventer which must be installed on the premises. The Public Works Director shall inform the owner in writing of the type of backflow preventer which must be installed within five (5) working days of receipt of necessary information. At such time thereafter as the owner requests installation of the water meter, the Public Works Director shall inspect the premises and, if the required backflow preventer has been properly installed and is in working order, shall approve installation of the meter.
(B) For premises receiving water service from the city as of the effective date of this subchapter, the Public Works Director may inspect the premises to assess the need for a backflow preventer. If he determines that a backflow preventer is required, he shall issue a written notice to the owner specifying the type of backflow preventer to be installed and setting the time by which installation must be completed.
(C) For premises receiving water service from the city as of the effective date of this subchapter which have existing backflow preventers, the Public Works Director may inspect the premises to assess the adequacy of the existing backflow preventer. If he determines that an additional or other type of backflow preventer is required, he shall issue a written notice to the owner specifying the type of backflow preventer to be installed and setting the time by which installation must be completed.
(D) Unless in the discretion of the Public Works Director, unusual circumstances require a shorter period of time, owners shall have ninety (90) days from receipt of notice in which to install the required backflow preventer. After the expiration of the ninety (90) day period, the Public Works Director shall reinspect the premises to determine compliance with the notice. If the owner has not complied with the notice, the Public Works Director shall issue a written order stating that, unless the owner has complied with the notice with fifteen (15) days from receipt of the order, water service to the owner's premises shall be immediately terminated without further notice.
(E) No owner who is required to install a backflow preventer under either subsections (A), (B), or (C) of this section shall remove the backflow preventer, render it inoperable, or make changes to the water system in his premises without first giving thirty (30) days written notice to the Public Works Director who may within that period issue such orders as are necessary to maintain compliance with this subchapter.
(F) Upon written application setting forth good cause and extenuating circumstances, which application is received by the Public Works Director before the expiration of any time period in which action is to be taken, the Public Works Director may, in his discretion, extend the period by not more than thirty (30) days.
(G) Notwithstanding any other provisions of this subchapter or other ordinances of the city, if at any time the Public Works Director determines that the connection between any owner's premises and the city's public water system constitutes a serious threat to the public health, he may terminate water service to the premises immediately.
