§ 51.109 SEWER SERVICE CHARGES (USER CHARGES)
   (A)   The revenues collected, as a result of the user charges levied, shall be deposited in a separate non-lapsing fund known as the Operation, Maintenance and Replacement Fund.
   (B)   Fiscal year-end balances in the Operation, Maintenance, and Replacement Fund shall be used for no other purposes than those designated. Monies which have been transferred from other sources to meet temporary shortages in the Operation, Maintenance and Replacement Fund shall be returned to their respective accounts upon appropriate adjustment of the user charge rates for operation, maintenance and replacement. The user charge rate(s) shall be adjusted such that the transferred monies will be returned to their respective accounts within six months of the fiscal year in which the monies were borrowed.
   (C)   The following schedule of user charge rates shall apply to each user of the wastewater treatment works.

   (D)   Consumer Price Index (CPI) adjustment of rates. On or before March 1 of each calendar year this section is in effect, the Treasurer for the city shall access from the Governor’s Office for Local Development, or its successor, the annual increase or decrease in the Consumer Price Index (CPI) of the preceding year as otherwise set out in KRS 83A.075 at the time of the enactment of this section. If the CPI has increased, the Treasurer shall calculate an increase of the rates and charges set out hereinabove by applying the CPI to each rate and charge. Notice of the CPI percentage increase of each rate and charge shall be mailed to each customer not later than May 30 and published in a local newspaper qualifying under KRS Chapter 424.
   (E)   Alton Water and Sewer District. The Alton Water and Sewer District shall be charged monthly for sewer service provided by the city treatment plant, the sum of one dollar and thirty-five cents ($1.35) for each one thousand (1,000) gallons of wastewater delivered to the city by those customers connected to the Alton Sewer System.
   (F)   Glenview Sewage Treatment System. As long as the city operates the Glenview Sewage Treatment System, users of that system shall be charged monthly, in advance, for sewer service provided by the Glenview system, a flat per connection fee of twenty-four dollars and fifty cents ($24.50) per month. The relationship of users of the Glenview system shall be governed, to the extent applicable, by the remaining provisions of this chapter. At such time as users of the Glenview system are connected to the city wastewater treatment works, they shall be subject to the charges then applicable to other users of that system.
   (G)   For residential, industrial, institutional and commercial users, monthly user charges will be based on actual water usage. If a residential, commercial, institutional, or industrial user has a consumptive use of water, or, in some other manner, uses water which is not discharged into the wastewater collection system, the user charge for the contributor may be based on readings of a wastewater meter(s) or separate water meter(s) installed and maintained at the user’s expense.
   (H)   For those users whose wastewater has a greater strength than normal domestic wastewater, a surcharge in addition to the normal user charge, will be collected.
   The following surcharge rates shall apply to each user of the treatment works that has received permission from the Superintendent or Designated Authority to contribute excessive strength sewage.

      (2)   No reduction in wastewater service charges, fee, or taxes shall be permitted because of the fact that certain wastes discharged to the wastewater works contain less than 450 mg/l of BOD, 300 mg/l of TSS, 40 mg/l of NH3-N, 100 mg/l of oil and grease, or an unclassified amount of other pollutant(s).
