§ 35.10 RIGHT OF BURIAL. 
   (A)   Only natural persons may purchase certificates for right of burial in the Lawrenceburg Cemetery.
   (B)   (1)   The right of burial in the cemetery shall be evidenced by a certificate for right of burial which shall be purchased from the City Clerk or such other person as may be designated from time to time by the Mayor.
      (2)   A copy of each certificate shall be maintained by the city and a copy shall be recorded in the office of the Anderson County Clerk.
      (3)   The right of burial as evidence by the certificate shall be conclusive for all purposes.
   (C)   Any right of burial which remains unused after the death and burial of the person or persons identified in the certificate shall pass by will or intestate succession in accordance with the laws of the Commonwealth of Kentucky.
   (D)   Ownership of a certificate for right of burial in the cemetery extends to the owner the sole right to bury the remains of one (1) person in that lot in accordance with the other provisions of this section. The Mayor, in his discretion, may waive this limitation for the burial of infants one (1) year old or younger and for the burial of cremated remains.
   (E)   No burial shall occur until the City Clerk or designee has issued a certificate for right of burial. Except as authorized under the financing plan described in division (N) herein, City Clerk or designee shall not issue a certificate until the purchase price has been paid in full. The city retains the right to waive the requirement for advance payment in extraordinary circumstances subject to the prior approval on an individual basis by the Mayor.
   (F)   Owners may transfer the right of burial in unused lots to other natural persons by gift or by sale at the then-prevailing price per lot established by ordinance if:
      (1)   The owner has paid all amounts owed to the cemetery;
      (2)   The owner obtains a new certificate in the name of the new owner; and
      (3)   The owner pays a eighty dollar ($80.00) fee to cover the administrative cost of the transfer.
   (G)   No partial interest in the right of burial in any lot may be transferred except to a person who has previously received a partial interest as a result of the death of the prior owner.
   (H)   As it is the object of the city to provide burial lots to as many of its citizens as possible, the city retains the right to resell the right of burial in unused lots after complying with any applicable law when there has been no contact with the owner or his heirs and assigns for a period of fifty (50) years.
   (I)   The city may at its sole discretion repurchase the right of burial in lots upon which no monuments have been installed from owners wishing to sell such right at the then prevailing price per lot less a eighty dollar ($80.00) administrative fee.
   (J)   No lot, or the right of burial therein, may be subdivided.
   (K)   No lot, or the right of burial therein, may be pledged as security for any debt or otherwise encumbered except for amounts owing to the city in accordance with the provisions of this section.
   (L)   The right of burial in cemetery lots shall be sold at the following prices:
      (1)   The right of burial in all lots in sections A through O: Seven hundred dollars ($700.00) per lot.
      (2)   The right of burial in all lots in sections P and Q and any subsequent sections opened after the effective date of this section:
         (a)   To persons residing in the city or persons owning real property within the city: Eight hundred dollars ($800.00) per lot.
         (b)   To all others: one thousand, two hundred dollars ($1,200.00) per lot.
   (M)   The right of burial in a Lawrenceburg Cemetery columbarium niche shall be sold at the following prices:
      (1)   The right of burial in any columbarium or similar facility now or in the future located in the Lawrenceburg Cemetery shall be sold:
         (a)   To persons residing in the city or persons owning real property within the city: Eight hundred dollars ($800.00) per niche.
         (b)   To all others: One thousand, two hundred dollars ($1,200.00) per niche.
      (2)   The right of burial in any columbarium or similar facility now or in the future located in the Lawrenceburg Cemetery grants to the purchaser the right to have the cremated remains of one (1) natural person buried in each niche.
      (3)   All etching which is intended to appear on niche doors shall be pre-approved by the sexton or his designee. If proposed etching is denied or altered by the sexton, or his designee, the decision may be appealed to the Mayor whose decision shall be final.
   (N)   The City Clerk shall establish a method and policy by which individuals may finance through the city, the expense involved in the purchase of the right of burial described herein as well as any other costs and expenses as may be set forth herein and which are associated with the burial or internment of a deceased individual. The City Clerk shall present such financing policy to the City Council for approval. The financing policy may be modified, from time to time, by the Clerk, with the approval of the Council. The City Clerk may issued a certificate for right of burial at any time during the financing period.
   (O)   Each person who purchases the right of burial in the Lawrenceburg Cemetery and who receives a certificate for right of burial from the city, shall simultaneously receive a city compiled brochure which fully and clearly outlines all city policies and ordinances relating to the operation maintenance and utilization of the Lawrenceburg Cemetery.
