§ 5-3-1-2. WATER METER DEPOSIT PROGRAM.
   (A)   New user water meter deposit.
      (1)   A water meter deposit of $75 per new residential utility customer shall be collected at the time of establishing service through the city’s water utility.
      (2)   When a water utility user moves from one residence to another also served by the city’s water utility, the water meter deposit may be transferred to the new residence, and a new water meter deposit shall not be required, upon a showing that the following conditions are met:
         (a)   Within the past one year, the account did not have more than one delinquent bill; and
         (b)   Within the past two years, the account did not have its service disconnected for non-payment.
      (3)   When a water utility user with no water meter deposit then on deposit with the city moves from one residence to another also served by the city’s water utility, no water meter deposit shall be required upon a showing that the following conditions are met:
         (a)   Within the past one year, the account did not have more than one delinquent bill; and
         (b)   Within the past two years, the account did not have its service disconnected for non-payment.
      (4)   When a user who has previously terminated his or her account, or whose account has been previously terminated by the water utility for reason of non-payment, desires to reactive the old account or to establish a new account after any period of time has elapsed, a new water meter deposit shall be required.
   (B)   Use of water meter deposit.
      (1)   The water meter deposit shall be held in trust by the city and applied to any unpaid water bills at the time of discontinuation of service or refunded to the customer if the water bill is paid in full through the end of water services.
      (2)   The water meter deposit shall be refunded after two years from the date of deposit if the following conditions are met:
         (a)   All balances remaining on the account have been paid in full;
         (b)   Within the past one year, the account did not have more than one delinquent bill; and
         (c)   Within the past two years, the account did not have its service disconnected for non-payment.
      (3)   Interest shall not be paid on any part of the water meter deposit.
