§ 5-2-6-31. STORM WATER VARIANCE PROCEDURE.
   (A)   The City Civil Engineer shall have the power to modify or waive any minimum standard found in this chapter or any regulations or master plans promulgated by the Board of Public Works and Safety pursuant to this chapter. The City Civil Engineer may, but is not required to, grant such a modification or waiver if an applicant for a storm water permit makes a substantial showing:
      (1)   That a minimum storm water standard or regulation is infeasible or unreasonably burdensome; and
      (2)   That an alternate plan submitted by the applicant will achieve the same objective and purpose as compliance with minimum standards and regulations.
   (B)   The request for variance together with supporting information shall be made in writing to the City Civil Engineer who shall make a decision within 20 calendar days and file a copy of his or her decision with the Board of Public Works and Safety.
