Whenever a storm water facility has become obstructed through the natural processes of siltation or deposition of debris, or due to a structural failure of the storm water conveyance system or facility such that threat to the public health, safety and welfare has been created, the owner may be notified in writing by the City Civil Engineer to perform the adequate maintenance and/or repair activities described by § 5-2-6-4. Violation of this section shall be deemed to constitute an environmental nuisance subject to enforcement and sanction under § 5-2-6-4.
