§ 5-2-4-6. RESTRICTIONS ON OPERATION.
   (A)   Residential prohibition. No facility shall be located within 1,320 feet, or one-fourth mile, of any residence or place of human habitation.
   (B)   Water well prohibition. No facility shall be located within 1,320 feet, or one-fourth mile, of a water well that is used in the production of water for human consumption.
   (C)   Open burning prohibition. Open burning of solid wastes is prohibited. All burning at a facility must be confined in an incinerator approved by the Indiana Environmental Management Board.
   (D)   Hazardous waste prohibition. No person shall deposit or store, or allow to be deposited or stored, any type of hazardous waste in any facility located within the City of Lawrence for any period of time whatsoever. Violation of this division (D) shall result in a fine of $2,500 for each violation and for each day that a violation continues.
   (E)   Scavenging prohibition. Scavenging at the facility shall be prohibited to avoid injury and to prevent interference with safe and proper operation of the facility.
   (F)   Salvaging restrictions. All salvaged materials must be stored daily at the facility in transportable containers or within buildings prior to removal from the site. Salvaged materials shall not be allowed to accumulate on the ground for any period of time whatsoever.
   (G)   Water pollution prohibition.
      (1)   In no case shall solid waste be deposited within an aquifer. In addition, the facility shall be so constructed so as to prevent the leakage or leaching of any contaminant or pollutant from the facility into the ground water in the area.
      (2)   A minimum of two ground water monitoring wells shall be drilled and maintained by the operator of a facility, to be located in areas designated by the Board.
      (3)   Weekly tests for contaminants and pollutants shall be conducted on ground water samples from the wells. The water samples shall be analyzed by the Indiana Department of Environmental Management.
      (4)   Tests performed on ground water samples shall include COD, pH, FeCl, conductivity and other tests deemed necessary by the Board. The cost of the testing shall be paid by the owners of the facility.
   (H)   Source of wastes. No permittee shall deposit any type of solid waste obtained from any area outside the limits of the City of Lawrence.
   (I)   Contour limitations. The contour of the existing topography at a facility must be restored to its original condition and elevation within 60 days of the completion of the filling operations at the facility. At no time during the operation of the facility shall the elevation over the landfill area exceed present contours by more than ten feet unless a prior exception is granted by the Board, and the exception shall only be valid for a period not to exceed 30 days.
   (J)   Surface water limitations. The owner or operator of a facility shall not allow the surface water at the facility to become stagnated and cause vector or odor problems.
   (K)   Volume limitations. No facility shall exceed 500,000 cubic yards in total gross volume.
