§ 5-2-2-7. STREET CONSTRUCTION; ACCEPTANCE OF STREETS; HEARING.
   (A)   Upon or before completion of construction, the applicant or his or her authorized representative shall make written application to the Board for acceptance for public maintenance by the Board of the streets and other improvements constructed pursuant to the street construction permit.
   (B)   Upon completion of all improvements and installations required by this code, the applicant shall furnish the Board with sufficient written proof that the improvements and installations have been constructed, installed and completed in compliance with the requirements and specifications of this code.
   (C)   Upon receipt of any application for acceptance of streets pursuant to this chapter and/or proof of compliance as required in division (B) above, the Board shall set a date for a hearing thereon and shall notify the applicant of the hearing, in writing, at least seven days prior to the date set for the hearing, unless the notice requirement is waived, in writing, by the applicant.
   (D)   If, at the hearing, the Board determines that the construction is complete and complies with all the requirements and specifications of this code, and that the maintenance bond required by this chapter has been posted, it shall take appropriate action to accept the streets and to notify the Commission that the performance of the construction has been completed to the satisfaction of the Board and that claims against any performance bond posted pursuant to the requirements of this chapter are released by the City of Lawrence and the Board.
