§ 5-1-6-13. DEDICATION AND REHABILITATION OF EXISTING SEWERS.

   (A)   The owner of a sanitary sewer may apply to the Department for dedication of the sewer, provided that the application is made in writing.

   (B)   Dedication of the sewer may be subject to the requirements outlined in §§ 5-1-6-8 and 5-1-6-9 and, further, at the discretion of the Director, may require the following:

      (1)   Proof of legal ownership;

      (2)   Flow monitoring results;

      (3)   Television inspection results;

      (4)   As-built record drawings; and

      (5)   Any other requirements as may be deemed reasonable and necessary by the Director.

   (C)   In addition, the owner, at his or her expense, may be required to correct any deficiencies or remove any sources of clear water found as a result of any inspection, flow monitoring, television and/or other related testing.
