(A) No privilege or power of eminent domain is bestowed by the grant of a franchise under this chapter. The grant of franchise does not confer any rights other than as expressly provided by this chapter or the franchise agreement.
(B) The franchise and the right it grants to use and occupy the public ways shall not be exclusive and do not explicitly or implicitly preclude the issuance of other franchises to operate cable systems or other communications systems with the City of Lawrence, affect the City’s right to authorize the use of public ways by other persons or entities to operate cable systems or other communications systems or for other purposes as it determines appropriate for the same or a different franchise territory, or affect the City’s right to itself construct, operate or maintain a cable system or other communications system, with or without a franchise as permitted by federal or state law.
