(A) Each person seeking a license to operate an adult bookstore or sexually themed business shall make application for a permit to operate the business with the Board of Public Works and Safety, which Board shall assist the City Controller in examining the credentials and character of applicants under this chapter.
(B) In addition to other information required of all permit applicants, permit applications under this chapter shall contain the following information and shall be individually signed by the applicant:
(1) Name, age, date of birth, citizenship and social security number of the applicant, if an individual; or of the manager and officers if the applicant is a corporation;
(2) If a partnership or corporation, the state in which organized, to include the name and address of its resident agent in the State of Indiana;
(3) Residence address and telephone number of the applicant;
(4) Business address and telephone number of the applicant;
(5) Street address of the location to be licensed;
(6) Name and address of the owner of the real estate in or upon which the business is to be operated;
(7) The location and duration of any other adult bookstore or museum location operated by the applicant presently or at any previous time, and whether the license was revoked at any time;
(8) If a similar business was previously operated, under what name was it operated and by whom;
(9) Whether the applicant or any partner or officer of the applicant has been convicted of any public offense concerning an act of violence, moral turpitude or sex offense; whether the offense has resulted in conviction of a second or subsequent offense; the specific offense upon which convicted; and the prosecuting authority which obtained the convictions;
(10) Nature of the business sought to be licensed;
(11) The number of mechanical or electrical amusement devices that are proposed to be located on the premises sought for licensing purposes, and the description and serial number for each such machine;
(12) The name of the manager or operator if not the applicant, and his or her business and residence address and telephone numbers;
(13) Signature of the applicant;
(14) Date of signing the application; and
(15) Notary public attestation.
